Injuries Due to Landlord’s Negligence.


New Jersey distinguishes people who are injured into three different categories trespassers, licensees and invitees. The standard of care owed to a person depends on their classification. Tenants are generally known  as licensees who are on the owner’s property with his permission but are not there at the invitation of the owner to conduct business. A landlord has a duty to exercise reasonable care in maintaining the property. A landlord has a duty to inspect/maintain/repair all parts of the property under the landlords control, including the common areas and the premises within the tenants apartment. This duty requires the landlord to exercise reasonable care to guard against foreseeable dangers arising from the use of the property.
